These Terms govern your use of Hyvo, provided by Hyvo Inc. By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service.

Hyvo provides AI-assisted tools for social media management: content creation, brand context and memory, planning, workflows, scheduling, and publishing to accounts you connect. Features may change, improve, or be withdrawn as the product develops.

Eligibility and your account
You may use Hyvo only if you can enter a binding agreement, provide accurate account information, and comply with these Terms and applicable law. If you use Hyvo for an organisation, you confirm you have authority to accept these Terms on its behalf.
You are responsible for your login credentials, for all activity under your account, and for telling us promptly if you suspect unauthorised access. Do not sell, transfer, or share your account.

Your content and what you publish
You keep ownership of the content you provide and the content Hyvo produces for you. You grant us only the licence needed to operate the Service: to store, process, and transmit that content so we can generate, schedule, and publish on your instruction.
You are responsible for what you publish. Before anything goes out you should confirm it is accurate, lawful, not misleading, and compliant with the rules of the platform receiving it. Approval steps do not transfer that responsibility to us.
AI-generated content
Hyvo uses AI models to draft and revise content. AI output can be inaccurate, incomplete, or unintentionally similar to other material, and similar prompts may produce similar results for different customers. Review AI output before publishing it.

Connected accounts
When you connect a social media account, you authorise Hyvo to act on that account as you have configured. Those platforms are controlled by third parties: their terms apply to your use of them, and changes to their APIs or policies may affect what Hyvo can do.
You may disconnect an account at any time. We are not responsible for the acts, outages, or policy decisions of third-party platforms.

Acceptable use
You may not use Hyvo unlawfully, deceptively, or in a way that harms others or interferes with the Service. This includes spam, impersonation, scraping, attempting to bypass rate limits or security controls, and publishing content you have no right to publish.

Intellectual property
Hyvo, including its software, design, and brand, remains our property. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service. You may not copy, reverse engineer, resell, or create derivative works from it.
If you send us feedback or suggestions, we may use them without obligation or payment to you.

Paid plans and cancellation
Some features require payment. Before you buy a paid plan you will be shown its price, billing frequency, applicable taxes, plan limits, and renewal terms. You agree to pay the charges for the plan you select.
We may change pricing or plan structure. Changes will not apply to a period you have already paid for, and we will give notice before they take effect. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period.

Suspension and termination
You may stop using Hyvo and delete your account at any time. We may suspend or terminate access if you breach these Terms or our policies, if required by law, or if your use puts the Service or other users at risk. Where circumstances allow, we will give notice first.
On termination, your right to use the Service ends. Retention and deletion of your data are covered in our Privacy Policy.

Availability, warranties and liability
Hyvo is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, that publishing to third-party platforms will always succeed, or that AI output will be accurate or fit for a particular purpose. Maintenance and outages can occur.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses, including lost profits, lost data, or reputational harm. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.
You agree to indemnify Hyvo Inc. against claims arising from your content, your published posts, your use of connected accounts, or your breach of these Terms. Nothing here excludes liability that cannot be excluded by law.

Governing law and changes
These Terms are governed by the laws of the State of Montana, United States, without regard to conflict of law rules. If any provision is found unenforceable, the rest remains in effect.
We may update these Terms as the Service develops. Material changes will be notified through the Service or by email, and the effective date above will be revised. Continuing to use Hyvo after a change means you accept it.
